§ 05
Disputes and arbitration
Commercial disputes, debt recovery and international arbitration, with settlement considered at every stage.
A dispute is a business decision as much as a legal one. Before we start, we tell you what winning would be worth, what it would cost and how long it would take, so you can decide with the full picture.
Many of our disputes cross borders: a supplier in another country, a contract under foreign law, an award to enforce abroad.
What we take on
- Contract and commercial disputes
- Debt recovery
- Shareholder disputes
- International arbitration
- Mediation
- Enforcement of foreign judgments
How the work runs
Case review
We read the documents and tell you, in writing, the strengths, the weaknesses and what the dispute is likely to cost.
Strategy
Negotiation, mediation, court or arbitration: we agree the route and a budget with you before we act.
Proceedings
We run the case and report after every step, with the budget updated as we go.
Resolution
A settlement, an award or a judgment, and the steps to enforce it if the other side does not pay.
How it is charged
Hourly rate
Hourly rates with a budget per stage that we agree in advance; other arrangements are possible for debt recovery.
Questions clients ask
Will my case go to court?
Most disputes settle before a hearing. We prepare every case as if it will be heard, which is often what makes settlement possible.
Can a judgment be enforced in another country?
Often, but the rules differ between countries. We check this at the start, because it changes whether the case is worth bringing.
